1. Acceptance of Terms

By accessing or using recalibrationlabs.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site. We may update these Terms from time to time as described in Changes to These Terms below.

These Terms apply to the Site only. Use of the aluni app is governed separately by the End User License Agreement, and data practices for both the Site and the app are described in the Privacy Policy.

2. Use of the Site

You may browse the Site, read its content, and download publicly offered assets (for example, press kit materials) for your personal or editorial use, consistent with any usage notes on the relevant page. You agree not to:

• Use automated means (scrapers, bots, crawlers) to extract content at scale beyond what is reasonable for search-engine indexing or the AI-agent access described in robots.txt and llms.txt;
• Attempt to gain unauthorized access to any part of the Site, its underlying infrastructure, or any account or system connected to it;
• Interfere with or disrupt the Site's operation, including through denial-of-service attacks or malware;
• Use the Site to transmit unlawful, infringing, or harmful content; or
• Misrepresent your affiliation with Recalibration Laboratories or the aluni app.

3. Intellectual Property

The Site's content - including text, graphics, logos, the "aluni" and "Recalibration Laboratories" names and marks, and the design of the Site itself - is owned by Recalibration Laboratories or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Press and editorial use: Journalists, bloggers, and other press may use assets published on the press kit page (such as the app icon) for the purpose of reporting on or reviewing aluni, consistent with any usage notes provided there. All other reproduction, distribution, or creation of derivative works requires our prior written permission - contact us at the address below.

4. Third-Party Links and Services

The Site links to third-party services we don't control, including the Apple App Store and email links to our own inbox via your mail client. We aren't responsible for the content, policies, or practices of third-party sites or services you reach through these links. Your use of the Apple App Store is governed by Apple's own terms, not ours.

If aluni offers subscription features, the price, billing period, and auto-renewal terms are shown to you by Apple through the App Store at the time of purchase and vary by region and currency - Apple sets and displays that pricing, not us. See the License Agreement for how to manage or cancel a subscription. Apple handles all billing and refunds for App Store purchases; see Apple's own refund process at reportaproblem.apple.com.

5. Communications and Submissions

If you contact us by email (for press, partnerships, waitlist, or any other reason), you're providing that information voluntarily, and it's handled as described in our Privacy Policy. If you send us feedback, suggestions, or ideas about the Site or aluni, you grant us a worldwide, royalty-free, perpetual license to use that feedback for any purpose, without obligation or compensation to you - the same treatment as feedback about the app itself under the License Agreement.

6. Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. We don't warrant that the Site will be uninterrupted, error-free, or secure, or that content on the Site (including statistics, facts, or figures on the press kit page) is free of error at every moment - we work to keep it accurate and correct mistakes when we find them, but we don't guarantee it.

Content on the Site is provided for general informational and marketing purposes. It is not professional, legal, or financial advice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Recalibration Laboratories and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site - regardless of the legal theory, even if we've been advised of the possibility of such damages.

To the extent not prohibited by applicable law, our total aggregate liability arising out of or relating to your use of the Site will not exceed fifty U.S. dollars (US$50). Some jurisdictions don't allow certain liability limitations, so some of the above may not apply to you.

8. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Recalibration Laboratories from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site in violation of these Terms or applicable law.

9. Dispute Resolution

We'd rather resolve disagreements informally - please contact us at the address below and give us a reasonable opportunity to address the issue before filing a claim. To the extent permitted by applicable law, any claim relating to these Terms or the Site may be brought only on an individual basis, not as part of a class, collective, or representative action, except that either party may bring an individual claim in small-claims court.

If you're a consumer resident in a jurisdiction that grants you a non-waivable right to a particular forum or procedure, this section doesn't limit that right.

10. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles, except where preempted by U.S. federal law. Subject to Dispute Resolution above, you and Recalibration Laboratories consent to the exclusive jurisdiction and venue of the state and federal courts located in California.

If you are a consumer habitually resident in the European Union, United Kingdom, or another jurisdiction with mandatory local consumer-protection law, nothing in this section deprives you of the protection of the mandatory provisions of the law of your country of residence.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Site or applicable law. We'll post the revised Terms here and update the "Last updated" date above; for material changes, we may provide additional notice. Your continued use of the Site after a revised version is posted constitutes acceptance of it, to the extent permitted by applicable law.
